Terms and Conditions

General

Unless otherwise stated, the artist retains full copyright on all artwork produced, including prints. As the copyright owner, I may submit artwork I produce for entry into exhibitions and /or publications.

Privacy Policy

I will not sell, distribute or lease your personal information to third parties. You are free to unsubscribe from my email list at any time.

Payment Processing

This website uses Stripe to process payments. Carol Frances Art will not collect or store your information.

Delivery

Regrettably I can currently only send to the UK. Delivery for greetings cards is free via second class postage. All paintings and drawings will be sent via tracked Royal Mail delivery service at a cost of £7.50. There is an option to select the appropriate postage option at the checkout. You are welcome to collect for free.

When you place an order through my online shop you will receive an automated email order acknowledgement. I will aim to despatch the item within 2 working days of receipt of the order. Please ensure that you have provided the correct delivery address as no responsibility will be taken for missing or delayed deliveries due to incorrect information. When I have posted the item, you will receive a second email, together with a tracking number (if applicable).

Returns (non-commissioned art)

I really hope you’re completely happy with your purchase but if you’re not, please let me know by email within 14 days of receipt. The item must be returned in suitably protective packaging within 28 days of receipt, and in a saleable condition. Unfortunately, I cannot consider a claim for returned goods lost in transit without proof of posting and for your peace of mind, I would advise you to return the item via a signed for service. Once I have received the item and checked it, I will process your refund and will advise you accordingly. Return postage will be at your expense.

If the item is damaged in transit please send photos of the damage to info@carolfrancesart.co.uk together with a clear description of the damage sustained (I will need this to send to Royal Mail in support of my claim for compensation). I will normally ask for the damaged item to be returned and will refund the cost of return postage once I have received the returned item.

Undelivered Items

All items will be sent via a tracked delivery service. However, I realise that very occasionally, items fail to reach their destination. If you have not received the item within 3 days, please double check that you provided the correct delivery address first and then email info@carolfrancesart.co.uk. I will need to raise the issue with Royal Mail and will come back to you via email with the outcome.

Commissioned Work Agreement

Thank you for entrusting me with your commission. I look forward to working closely with you to create an artwork which will be treasured for years to come. This document is to ensure we are in agreement on how to proceed.

The Project

An original hand drawn pencil portrait based on reference photographs supplied by yourself. The size and format (square, portrait or landscape) will be confirmed separately by email once we have agreed on the photograph/s and composition.

The drawing will be supplied mounted with a backing board ready for framing.

Photographs

Photographs need to be clear and representative of the pet and colouring, ideally taken outside on a cloudy but bright day. I will send guidance on taking/sourcing photos.

Photographs must have been taken by you, or the permission for use obtained in writing from the person who took them. If the photographs have been taken by someone other than you, I will assume you have the required permission. If the portrait is to be a gift, you accept responsibility for sourcing and using images that are of the recipient's pet.

Copyright

As the artist, I reserve all copyrights and reproduction rights to all commissioned works, unless agreed otherwise.

As the artist, I reserve the right to display the completed portrait on my website and on my social media pages. If you do not wish your commissioned portrait to be shown online, please notify me before work commences. Whilst I retain the full copyright on the artwork and prints, I will not use your commissioned portrait to print from for items I intend to sell, (ie, for greetings cards etc). As the copyright owner I may submit your commission for entry into online exhibitions and/or publications.

Payment

A booking fee of £20 will secure a slot in my diary and 50% of the portrait cost is required before I start the commission (or a 50% payment will also secure a slot in my diary). The booking fee is refundable until I start work on the portrait. "Starting work" includes layouts and mock-ups. I will notify you one week before starting any work on the portrait. After I have commenced work, the booking fee becomes non-refundable.

On completion (and before the portrait is sent) the balance will be due, including postage.

I can offer payment by instalments. Please contact me if you would like to pay by instalments.

Payment should be made by bank transfer, the details of which will be confirmed in an email.

Changes

Before I start the drawing, or whilst I'm in the process of drawing, I may suggest or ask if you want to change certain things such as tidying up a bridle, or removing a collar. Once the drawing is complete, it's not possible to make any changes.

Cancellation

If you decide to cancel the commission after the work has started, you are free to do so and no further payment will be required. There will be no refund of the booking fee and I may complete the portrait and sell the portrait via my website or art event as recompense for my time spent on the portrait.

Right of Refusal

I really hope you are happy with your portrait but if, on completion of the drawing you decline to purchase the finished artwork, you are under no obligation to purchase the portrait or pay the remaining balance and no further payment will be due. The booking fee will not be refunded and I may sell the portrait via my website or art website as recompense for my time spent on the portrait.

Delivery

All orders are sent via a tracked delivery service (normally Royal Mail) to the address you provide (I will provide tracking details). You are welcome to collect – I live in Hampshire so please ask if you think this might be an option for you.

Damage in Transit

Your portrait will be well packaged and I hope it reaches you in perfect condition. If, in the unlikely event that damage occurs during transit, please send a photo of the damaged packaging, together with a photo of the damaged artwork immediately. Depending on the extent of the damage, the portrait may need to be returned to me and a new portrait will be drawn at no extra cost. The new portrait will be added to my waiting list.

This Agreement should be read in conjunction with the general terms and conditions on my website.
